Publication Agreement Terms(Required) VIEWS Publication Agreement
By agreeing to the terms of this publication agreement, the contributor agrees to transfer all rights, including the copyright, for the article to the Registry of Interpreters for the Deaf, Inc. (hereinafter referred to as RID). Upon publication, exclusive rights, including all subsidiary rights, will automatically be transferred to RID. We ask that you consider the following terms of publication before signing this agreement.
Approval and Acceptance: We agree that publication of the aforementioned article depends upon its acceptance by the editor of VIEWS and upon its adherence to the editorial standards of RID. Nothing in this agreement obligates RID to publish the article. In fact, RID is allowed 12 months from the date of this agreement to publish the article. After this period, upon written request by the contributor, RID shall release all rights of the article to the contributor.
Copyright Assignment: While both RID wishes to publish the article and you wish for the article to be published, you now grant and assign exclusive use of the entire copyright of the article to RID. The copyright consists of any and all rights now and hereafter protected by the copyright laws of the United States of America and of all foreign countries in any form of communication. RID shall be the sole owner of these rights which include, but are not limited to, the following: the right to make copies of the article (by printing, by digital reproduction, and by any media now in existence or later developed), the right to distribute innumerable copies of the article to the public, the right to create derivative works which will be owned by RID, the right to display the article publicly, both in print and in an electronic format, such as online publishing, and the right to license any of the above rights to any other publisher.
Warranty: By signing this agreement, you guarantee that the article is your original work and that the work is owned by you. You hereby warrant that, in the case of a multi-authored article, all contributors of the article have signed as parties to this agreement. You acknowledge that the copyright to this article has not been registered with the United States Copyright Office. In the event that such registration has occurred, you will transfer the copyright to RID in a timely fashion. You also agree that the article doesn’t libel or infringe upon any individual’s right to privacy. If data or statistics are included in the article, you agree that all statements of facts are accurate to the best of your knowledge.
Previous Publication and Permission: You warrant that the article has not been previously published and that no other agreement for publication of this article, either in part or in whole, exists at the time of this agreement. If the article contains any information which requires written permission, you agree to cooperate with RID in identifying any portions of the article which are non-original. Moreover, you acknowledge that you have obtained the necessary permission(s) from the copyright owner at your own expense and agree to submit these permissions with the article for approval by RID.
Proofhandling: RID may make changes to the article to fit the organization’s current editorial standards, including, but not limited to, a change of the article’s title.
Educational Use: RID may authorize schools, other non-profit or grassroots organizations, etc. to use up to 200 copies of the article in classrooms, seminars, etc. and/or to reprint or reproduce the article in a circulation newsletter, magazine, etc. Similarly, the contributor reserves the right to utilize at no cost the article for scholarly or educational purposes, provided that: such usage is solely for noncommercial purposes, proper acknowledgment is given to the source, RID has been notified in writing of the contributor’s said intent, and the article is not used in any way that implies endorsement by RID or VIEWS of any product or service of any person and/or entity.
Best Efforts: The contributor and RID agree to use their best efforts in the implementation of this agreement. The contributor also warrants that he or she will hold harmless and indemnify RID, its parents, affiliates, successors, assignees, representatives licensees, and any agent, servant and/or employee thereof against any and all claims, damages, liabilities, losses or expenses (including reasonable attorney’s fees, legal costs, and expenses) arising from any breach or alleged breach of the contributor’s warranties and representations contained in this agreement or resulting from the use in any manner of the article by RID.
Termination: This agreement may be terminated by RID if the contributor does not adhere to the terms of publication or herein established.
Amendment: This agreement comprises the entire agreement between the contributor and RID and overrides all previous agreements, both written and oral. This agreement may be amended only by an addendum which has been agreed upon and signed by both the contributor and RID.
Governing Law: This agreement shall be governed by the laws of the State of Virginia without regard to the conflicts of the law.
